Welcome to Selfie AI. These Terms of Use govern your use of the Selfie AI mobile application ("App") and related services provided by Alexandre Grisey ("Company," "we," "us," or "our"). By accessing or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.
By downloading, installing, or using the Selfie AI App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. These Terms constitute a legally binding agreement between you and Alexandre Grisey.
Selfie AI is a mobile application that allows users to create AI-generated images based on user-uploaded photos. The App uses artificial intelligence to generate new images in various styles and settings based on the user's uploaded photos.
You must be at least 16 years of age to use this App. If you are under 16 years of age, you represent that you have your parent or guardian's permission to use the App. Users under the age of 16 are not permitted to use the App under any circumstances.
4.1. You may be required to create an account to use certain features of the App.
4.2. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4.3. You agree to provide accurate and complete information when creating your account and to update your information to keep it accurate and current.
5.1. "User Content" refers to any images, photos, or other content that you upload to the App.
5.2. You represent and warrant that:
- You own or have the necessary rights to the User Content you upload;
- Your User Content does not violate the privacy rights, publicity rights, copyright, contractual rights, or any other rights of any person; and
- Your User Content does not contain any content that is illegal, offensive, abusive, or otherwise objectionable.
5.3. We have the right to remove any User Content that violates these Terms or that we find objectionable for any reason.
You agree not to use the App to:
6.1. Upload or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable;
6.2. Upload or generate nude, partially nude, sexually explicit, pornographic, or adult content;
6.3. Generate images of public figures, celebrities, or other individuals without their consent;
6.4. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
6.5. Engage in any activity that could disable, overburden, damage, or impair the App;
6.6. Use any robot, spider, or other automatic device to access or use the App;
6.7. Violate any applicable local, state, national, or international law.
7.1. The App and its original content (excluding User Content), features, and functionality are owned by Alexandre Grisey and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7.2. You may not copy, modify, create derivative works from, distribute, publicly display, publicly perform, republish, download, store, transmit, sell, or otherwise exploit any content from the App without our express prior written permission.
7.3. Generated Images: The ownership of AI-generated images created through the App is subject to the following terms:
- You retain ownership of your original User Content (photos you upload).
- You are granted a license to use the AI-generated images for personal, non-commercial purposes.
- Commercial usage rights for AI-generated images may be available through premium subscriptions or separate agreements.
8.1. The App may offer in-app purchases, including but not limited to credits, subscriptions, or premium features.
8.2. All purchases are final and non-refundable, except as required by applicable law.
8.3. You acknowledge that you are responsible for any in-app purchases made through your account, whether or not authorized by you.
8.4. Credits expire after 12 months from the date of purchase unless otherwise specified.
8.5. Subscriptions automatically renew for the same subscription period unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions through your device's app store account settings.
9.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALEXANDRE GRISEY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS APP.
9.2. IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR €100, WHICHEVER IS GREATER.
10.1. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
10.2. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10.3. We cannot guarantee the accuracy or quality of AI-generated images.
You agree to indemnify, defend, and hold harmless Alexandre Grisey and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use or misuse of the App or your violation of these Terms.
The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
13.1. We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
13.2. Upon termination, your right to use the App will immediately cease.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Please review our Privacy Policy, which also governs your use of the App and explains how we collect, use, and disclose information about you. By using the App, you also agree to our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Bordeaux, France.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
These Terms constitute the entire agreement between you and Alexandre Grisey regarding the App and supersede all prior agreements and understandings, whether written or oral.
